Template 9089 is a document that the US Department of Labor issues to employers seeking a Permanent Labor Certification for their foreign employees.

In order to apply for it, the employer needs to do the following:

Fill out a full-time job offer with fair market compensation.

Prove due effort was given to hire a U.S. citizen before the foreigner.

Assure that the foreign employee will perform the tasks stated in the job offer.

When is Eta Form 9089 Approval Time?

The employer has to apply for this Eta Form once the recruitment process is finished. The application can take up to 6 months to complete. In some cases, the process can be quicker as long as the US DOL doesn’t audit the filed sample or the employer.

Where to File Eta Form 9089?

If the template is being filed without a Schedule A, it should be filed to the Department of Labor. Taxpaying employers can either file the template electronically or send it by mail. If it is accompanied by a Schedule A, it should be mailed to the U.S. Citizens and Immigration Services in the state where the job is based.
